Front Range Classifieds, TOWN OF FREDERICK, COLORADO ORDINANCE NO. 1171 AN ORDINANCE OF THE TOWN OF FREDERICK COLORADO, AMENDING CHAPTER 13, ARTICLE II OF THE TOWN OF FREDERICK MUNICIPAL CODE. WHEREAS, the Board of Trustees of the Town of Frederick finds it necessary to amend Chapter 13, Article II of the Frederick Municipal Use Code, to clarify the sewer service requirement as a condition of receiving water service from the Town. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FREDERICK, COLORADO, AS FOLLOWS: Section 1. Section 13-54 of the Frederick Municipal Code is hereby repealed in its entirety and reenacted to read as follows: "Sec. 13-54. Sewer service requirement. As a condition of receiving water service from the Town utility, an applicant must connect to the Saint Vrain Sanitation District for sanitary sewer service per the latest IGA between the Town and the District. A written notice indicating the recommendation of the St. Vrain Sanitation District and compliance therewith by the applicant shall be received by the Town prior to physical connection to the Town water utility by the applicant. The terms of such sewer connection shall be determined by the District Board of Directors. Under special circumstances, the requirement to connect to the St. Vrain Sanitation District may be waived or postponed upon approval of the Town of Frederick Board of Trustees. Any existing or proposed septic systems must comply with the Weld County Department of Public Health and Environment standards and would operate under their jurisdiction." Section 2. Effective date. This ordinance shall be published and become effective as provided by law. Section 3. Severability. If any part, section, subsection, sentence, clause, or phrase of this ordinance is for any reason held invalid, such invalidity shall not affect the validity of the remaining sections of the ordinance. The Town hereby declares that it would have passed the ordinance including each part, section, subsection, sentence, clause or phrase thereof, irrespective of the fact that one or more part, sections, subsections, sentences, clauses, or phrases be declared invalid. Section 4. Repealer. All ordinances or resolutions and motions of the Board of Trustees of the Town of Frederick or parts thereof in conflict with this ordinance are, to the extent of such conflict, hereby superseded and repealed, provided that such repealer shall not repeal the repealer clauses of such ordinance, resolution or motion, nor revive any ordinance, resolution, or motion thereby. The Department of Homeland Security's Federal Emergency Management Agency (FEMA) solicits technical information or comments on proposed flood hazard determinations for the Flood Insurance Rate Map (FIRM), and where applicable, the Flood Insurance Study (FIS) report for your community.
